Background:
The “John Doe” amendment provided that anonymous whistle-blowers could not be sued for reporting suspicious terror related activities (read full amendment text here.) Since the amendment was attached to an unrelated bill (an outrage in itself), it required a super-majority (60%) to pass. The measure failed by three votes. Here are your illustrious senators who voted NAY:

Akaka (D-HI)
Biden (D-DE)
Bingaman (D-NM)
Boxer (D-CA)
Brown (D-OH)
Byrd (D-WV)
Cantwell (D-WA)
Cardin (D-MD)
Carper (D-DE)
Casey (D-PA)
Dodd (D-CT)
Durbin (D-IL)
Feingold (D-WI)
Harkin (D-IA)
Inouye (D-HI)
Kennedy (D-MA)
Kerry (D-MA)
Klobuchar (D-MN)
Kohl (D-WI)
Lautenberg (D-NJ)
Leahy (D-VT)
Levin (D-MI)
Lincoln (D-AR)
McCaskill (D-MO)
Menendez (D-NJ)
Mikulski (D-MD)
Murray (D-WA)
Nelson (D-FL)
Pryor (D-AR)
Reed (D-RI)
Reid (D-NV)
Rockefeller (D-WV)
Salazar (D-CO)
Sanders (I-VT)
Stabenow (D-MI)
Tester (D-MT)
Webb (D-VA)
Whitehouse (D-RI)
Wyden (D-OR)

It is important to note that there were four who did not vote, which could have changed the outcome:

Brownback (R-KS)
Feinstein (D-CA)
Johnson (D-SD)
Obama (D-IL)

It is also interesting to note that two of these are presidential candidates. If they are mum on protecting you now, how will they protect you in the Oral Oval Office?

The case of the “flying imams” isn’t about whether or not they were actually planning an act of terrorism, they weren’t. Their suspicious activities were a ruse. It was about probing, eroding and taking away another line of defense against the dhimmification of America. And Islamic fascism is winning.

Update -The voice of the American people has been heard:
After nearly a week of intense, behind-the-scenes wrangling, congressional negotiators late Tuesday agreed to include in the pending Sept. 11 security bill sweeping liability protections for citizens who report suspicious activity they fear might be linked to terrorism.
